NSW Police will also allege he became aggressive as officers tried to arrest him.
He was eventually taken into custody and allegedly returned another breath analysis of 0.30.
His five passengers, all children aged between 10 and 4, remained at the scene with police until the arrival of family members.
The driver has since been charged with high-range drink driving and resisting arrest.
His licence was suspended and he is due to face Penrith Local Court on June 24.
