A Gold Coast lawyer has been busted driving more than six times the legal alcohol limit with his 10-year-old daughter in the car.

Lawyer Malcolm John McBratney, 42, was arrested after he recorded an alarming 0.326 blood alcohol reading following a drive to a seafood shop in Paradise Point on August 31, 2015.

Appearing in the Brisbane Magistrates Court, Mcbratney was fined $1000 and banned from getting behind the wheel of a car for a year after pleading guilty to driving under the influence.

The court heard horrifying details of the incident, including how a witness saw the young girl getting into the drivers seat of the white BMW vehicle before a bystander stepped in and confiscated the keys.

CCTV footage from the takeaway shop also showed the young girl guiding her father to a seat and helping him pay for food.

Magistrate Anne Thacker said it was one of the highest-range drink driving cases she has ever seen.

“You posed a very high level of danger to other road users and placed a 10-year-old in a very serious position.”

“You should not be driving for a long period of time,” she told him.

McCullough Robertson lawyers should take action to remove this man from practice until he behaves better. What disgraceful conduct. The Queensland law society should also do something about it.
