Tomic is due to appear in court on the first day of the US Open, having already sent a written plea of not guilty following a wild night in a Miami beach hotel.

It is understood the plea leaves open the option for the court to sentence Tomic with a diversion program such as community service.
Tomic was arrested on July 15 after police claim he was aggressive and belligerent when asked no less than three times to turn down the music in his swanky penthouse suite.
